Family Files Lawsuit After Woman Dies During Fishing Tournament

__Lawsuit_

When people participate in tournaments, they expect to have fun and maybe engage in a little competition. However, very few expect to die.

Sadly, this very thing happened to a South Carolina woman. The 25-year-old woman from Aiken was one of four people on a fishing boat during The Striped Bass Challenge. She was on the boat with her boyfriend and his family when the boat began to sink in the freezing water due to strong winds.

All four occupants of the boat were thrown into the water approximately 300 feet from the shore. One victim swam to shore, while two were assisted by another boat. The woman was located just off the shoreline in the water. The victim had been in the water for as long as 20 minutes prior to being rescued.

Anderson County Emergency Management, Dive teams, EMS, Fire and Uniform Patrol all responded to the scene. While the three other passengers were rescued, the woman was unconscious. First responders performed CPR on her. She was taken to AnMed hospital, where she later died. Her cause of death was freshwater drowning. Her death has been ruled as accidental.

The incident happened on Lake Hartwell in January 2025. The victim’s family has filed a wrongful death lawsuit against the tournament staff, citing negligence. The lawsuit raises questions about whether safety measures could have prevented the fatal incident.

The tournament director’s son had outfitted the boat with an engine that was larger than recommended by the manufacturer. The lawsuit also claims personal flotation devices were not easily accessible. It was determined that the boat was overloaded, did not have readily accessible personal flotation devices, and would be extremely dangerous given the weather conditions that day.

When Can an Event Organizer Be Held Responsible?

Whether an organizer or other party can be held liable depends on the specific circumstances surrounding the accident. A lawsuit may examine whether the responsible parties knew or should have known about a dangerous condition and whether they took reasonable steps to address it. Potential issues may include inadequate safety procedures, insufficient warnings, unsafe equipment, hazardous property conditions or a failure to respond appropriately to a known risk.

The fact that an accident occurred does not automatically establish negligence. To prevail in a wrongful death or negligence claim, a plaintiff generally must establish that the defendant owed a legal duty, breached that duty, and that the breach caused the death and resulting damages. This may require an investigation into what happened before, during and after the incident through the use of various forms of evidence.

When a person dies because of another party’s alleged negligence, surviving family members may have the right to pursue a wrongful death claim. Depending on applicable state law, damages may include medical and funeral expenses, lost financial support, and loss of companionship.
