Pedestrian Killed in Columbia Crash

Car accidents can be deadly, especially when they involve people getting hit by vehicles. Sadly, this is what happened to a person in South Carolina.
Columbia police responded to an accident in Columbia on September 22. A vehicle was heading west in the 7600 block of Garners Ferry Road when it hit a pedestrian. The person died from their injuries. Their identity has not been released.
According to police, the pedestrian was in the roadway illegally. They were not in a designated crosswalk at the time of the crash. The accident is still under investigation.
Pedestrians Illegally in the Roadway
Pedestrians who walk or stand in areas where pedestrian travel is prohibited can face significant dangers. Entering a roadway outside a designated crossing, walking along a freeway, or crossing against a traffic signal can put pedestrians in the path of vehicles traveling at much higher speeds.
Common dangers include:
- Being struck by a vehicle: Drivers may have little time to react when a pedestrian suddenly enters the roadway.
- Limited visibility: Pedestrians can be difficult to see at night, around curves, near hills, or behind parked or stopped vehicles.
- High-speed traffic: A pedestrian hit by a vehicle traveling at highway or freeway speeds can suffer catastrophic or fatal injuries.
- Distracted drivers: Drivers using phones or otherwise distracted may fail to notice someone in the roadway.
- Multiple-vehicle collisions: After an initial impact, a pedestrian can be thrown into another lane and struck by additional vehicles.
- Impaired drivers: Alcohol or drugs can affect a driver’s ability to recognize and respond to a pedestrian hazard.
- Wrong-way or unexpected movement: A pedestrian walking against traffic or entering a lane unexpectedly may be especially difficult for motorists to anticipate.
- Freeway exposure: Pedestrians on freeways face particularly serious risks because vehicles generally travel at high speeds and drivers do not expect pedestrians to be present.
However, a pedestrian’s presence in a prohibited area does not automatically mean the pedestrian is solely responsible for a collision. Liability depends on the circumstances and the applicable state law. A driver’s speed, attentiveness, impairment, failure to yield, or other conduct may also contribute to a crash. Even when a pedestrian is illegally in the roadway, drivers generally still have a duty to operate their vehicles with reasonable care.
In some cases, though, a pedestrian’s violation of traffic laws can affect a personal injury claim. Comparative or contributory negligence rules may reduce or, in some circumstances, prevent recovery depending on the facts.
