Boy Seriously Injured at Daycare Facility

A South Carolina family has filed a lawsuit against a Lancaster County daycare center, alleging that its failure to properly supervise a 2-year-old boy contributed to two separate injuries within a three-month period.
The child’s family enrolled him at Buford Child Development Center and initially had a positive experience. The family’s concerns reportedly began in January, when the child suffered a fractured ankle while at the facility.
The parents allegedly were not informed about the injury until they arrived to pick up their son. The complaint states that the child had reportedly been crying for an extended period, but daycare personnel did not provide the parents with an explanation for how the injury occurred.
The family later raised concerns with daycare management and asked that additional safety measures be implemented, including ensuring the child wore shoes while walking. The lawsuit alleges that the daycare failed to take adequate corrective measures.
The family’s concerns escalated several months later when, on April 22, the toddler allegedly fell inside a classroom and suffered a complete fracture of his femur. Surveillance video reportedly shows the child falling to the floor and crying in pain. Another portion of the footage appears to show a daycare employee walking near the child while he remained on the floor.
The lawsuit alleges that the child remained on the floor for approximately 14 minutes before receiving assistance. His mother reportedly was not notified about the injury for more than 30 minutes.
The child was eventually taken to a hospital in Lancaster, where he underwent surgery and was placed in a cast. His subsequent medical treatment reportedly included care at multiple hospitals. The boy also developed pneumonia while receiving treatment.
According to court documents, the family’s medical expenses have exceeded $70,000. The parents also reportedly missed work while caring for their son. The lawsuit names the daycare and several individuals and seeks compensation in an amount to be determined by a jury.
Daycare Supervision and Child Injuries
Daycare providers have a responsibility to provide appropriate supervision and maintain reasonably safe environments for children in their care. Young children may be particularly vulnerable because they often lack the judgment, coordination or ability to recognize hazards that adults possess.
Adequate supervision can include maintaining appropriate child-to-staff ratios, monitoring children during activities, responding promptly when a child is injured and notifying parents when an injury requires medical attention.
When a child is injured at a daycare, determining what happened can involve reviewing surveillance footage, staffing records, incident reports, medical records and witness statements. Investigators may also examine whether the facility followed applicable licensing and safety requirements.
