Child Killed, Adult Injured in Dog Attack

Dog attacks can happen to anyone, but children and the elderly are sadly the most vulnerable to injuries and fatalities.
Tragically, a child was recently killed in a dog attack. The fatal accident occurred on the morning of June 27 in Dorchester County. An adult was also injured in the incident while trying to protect the child.
Deputies with the Dorchester County Sheriff’s Office responded to a home in Ladson after receiving a report of an active disturbance. When deputies arrived, they found an adult and a child with injuries due to a dog attack. Preliminary information indicated that multiple dogs may have been involved. It was later determined that two large dogs (a pit bull terrier and a bull mastiff) had attacked the child.
Both victims were transported to Trident Medical Center for treatment. The child later died from their injuries.
Under South Carolina law, the South Carolina Law Enforcement Division was notified of the child’s death.
Dealing With Child Injuries in South Carolina
When a child is injured because of a dog attack, car accident, unsafe property or another preventable incident, parents and caregivers may face significant medical, emotional and financial challenges. Children can suffer serious injuries even when an incident initially appears minor, making prompt medical attention important.
In South Carolina, the circumstances surrounding a child’s injury can also affect whether another person or entity may be legally responsible. Depending on what happened, potentially responsible parties could include a dog owner, property owner, driver, business or other negligent party.
Parents should seek appropriate medical care and keep records of the child’s treatment, including hospital visits, diagnoses, medications, follow-up appointments and other medical expenses. It can also be helpful to document the accident scene, preserve photographs and keep information about witnesses.
If a child was injured in a dog attack, parents should also report the incident to the appropriate authorities and obtain information about the dog and its owner when possible. South Carolina law may impose liability on a dog owner when a dog attacks or bites a person under certain circumstances.
Because a child generally cannot manage a personal injury claim independently, a parent or legal guardian may need to take legal action on the child’s behalf. South Carolina also has specific rules governing claims involving minors, including rules concerning settlements and the use of court proceedings in certain circumstances.
